Rental agreement

This is the agreement you sign before every rental. Version 2026-08-v1.

The short version

  • You must be 18+ with a valid driver's licence.
  • We do not insure the trailer or your cargo — you are responsible for damage or loss regardless of fault.
  • Your tow vehicle must be rated to tow the loaded trailer, with the correct ball size and connector.
  • Trailers with electric brakes require a brake controller in your tow vehicle.
  • Return it on time and swept out — late and cleaning fees apply otherwise.

1. The Agreement

This Trailer Rental Agreement ("Agreement") is between Royal Road Rentals, of 1467 Hammonds Plains Road, Halifax, NS B4B 1P6 ("Owner", "we", "us"), and the person named and signed below ("Renter", "you"). It applies to the trailer identified in this Agreement (the "Trailer") for the rental period shown.

By signing electronically, you confirm that you have read this Agreement, that the information you provided is true, and that you accept the terms below.

2. Who May Rent and Tow

You must be at least 18 years of age and hold a valid driver's licence. You must provide a legible photo of the front and back of that licence before pickup.

Only you may tow the Trailer. You may not permit any other person to tow it, and you may not sublet, re-rent, lend, or assign the Trailer to anyone.

3. Rental Period and Late Returns

The rental period runs from the pickup date to the return date shown in this Agreement. Rental days are counted inclusively — a pickup and return on the same day is one day.

If you return the Trailer after the agreed return date without our written approval, you will be charged a late fee of 1.5 times the daily rate for each additional day, plus any losses we incur from a booking we could not fulfil.

If the Trailer is not returned and we cannot reach you, we may report it as stolen and recover it at your expense.

4. Rates, Taxes, and Deposit

Rental charges are as shown in this Agreement. All rates are subject to 15% HST (Nova Scotia).

A refundable security deposit is collected at pickup. We may apply the deposit against unpaid rental charges, late fees, cleaning fees, damage, loss, fines, or recovery costs. Any balance is returned to you after the Trailer is inspected on return. If the amount owing is greater than the deposit, you remain responsible for the difference.

Payment is due at pickup unless we have agreed otherwise in writing.

5. Insurance — Read This Carefully

WE DO NOT PROVIDE INSURANCE ON THE TRAILER, ON YOUR TOW VEHICLE, OR ON YOUR CARGO. This is the single most important term in this Agreement.

In Nova Scotia, a trailer being towed is generally covered for third-party liability under the automobile policy of the vehicle towing it, but damage to the trailer itself is usually NOT covered unless your policy specifically extends to non-owned trailers. It is your responsibility to confirm with your own insurer, before pickup, what your policy covers.

You agree that you are responsible for physical damage to, or loss of, the Trailer during the rental period regardless of fault, up to its full replacement value, whether or not your insurance responds.

You must hold valid automobile insurance on the tow vehicle for the entire rental period.

6. Safe Towing and Load Limits

You are responsible for hooking up and towing the Trailer safely and lawfully. Before each trip you must confirm that the coupler is fully seated and latched onto the correct ball size, that safety chains are crossed and attached, that the electrical connector is plugged in and all lights work, that the tires are properly inflated, and that any load is secured.

You must not exceed the Trailer's Gross Vehicle Weight Rating (GVWR) or its rated payload, and your tow vehicle must be rated by its manufacturer to tow the loaded weight.

If the Trailer is equipped with electric brakes, your tow vehicle must have a functioning brake controller. Towing a braked trailer without a controller is prohibited under this Agreement.

You are responsible for securing your load. Anything that falls from the Trailer is your responsibility, including any resulting damage, injury, or fine.

7. Permitted Use

The Trailer may be used only for lawful purposes and only on roads and surfaces it is suited to. You may not use it to carry hazardous, flammable, explosive, or illegal materials, to carry passengers or animals, in any race or contest, or in any way that violates the law.

The Trailer may not be taken outside Atlantic Canada without our prior written consent.

You may not modify, repaint, or alter the Trailer, or remove any decal, plate, or identifying mark.

8. Condition and Return

We inspect and photograph the Trailer with you at pickup and again at return. You should raise any concern about its condition before you leave with it.

You must return the Trailer to our Hammonds Plains location on the agreed date, in the same condition you received it, reasonably clean and empty of all debris and cargo.

A cleaning fee applies if the Trailer is returned requiring cleaning before it can be rented again. This is common with dump and utility trailers — sweeping it out before return avoids the fee.

9. Damage, Loss, and Theft

You must report any accident, damage, theft, or vandalism to us as soon as possible, and to the police where the law requires it.

You are responsible for the cost of repair or replacement, for our loss of rental income while the Trailer is out of service, and for any towing or recovery costs.

Do not arrange your own repairs. Any repair you authorize without our written consent is at your own cost.

10. Breakdown on the Road

If the Trailer becomes unsafe or unusable through no fault of your own, stop in a safe place and call us at (902) 832-9067. We will arrange a repair, a replacement, or a refund for the unused portion of the rental.

Our responsibility in that situation is limited to the rental charges you paid. We are not responsible for your fuel, lost time, missed work, or other trip costs.

11. Tickets, Fines, and Tolls

You are responsible for all traffic and parking violations, tolls, impound charges, and related administrative costs incurred during the rental period, including any received by us after the rental ends.

12. Responsibility and Indemnity

You agree to indemnify and hold harmless Royal Road Rentals, its owners and staff, from any claim, loss, damage, injury, or expense arising out of your use of the Trailer, except to the extent caused by our own negligence.

To the fullest extent permitted by law, our total liability under this Agreement is limited to the rental charges you paid for the rental in question. We are not liable for indirect or consequential losses.

Nothing in this Agreement limits any right you have that cannot be limited under the Nova Scotia Consumer Protection Act or other applicable law.

13. Cancellation and Repossession

You may cancel a booking at no charge before the rental begins by cancelling in your account or calling us.

We may end this rental and repossess the Trailer at any time, without notice, if you breach this Agreement, if the Trailer is being used unsafely or unlawfully, or if it appears to be at risk. You are responsible for our reasonable recovery costs.

14. Privacy

We collect your name, contact details, date of birth, driver's licence images, and tow vehicle details in order to rent to you, verify eligibility, and meet our record-keeping obligations. We do not sell your information. Licence images are stored securely and retained only as long as we need them for our records.

15. Governing Law and Electronic Signature

This Agreement is governed by the laws of the Province of Nova Scotia and the laws of Canada that apply in it.

You consent to signing this Agreement electronically. You agree that your typed name and drawn signature, together with the date, time, and IP address recorded when you sign, have the same legal effect as a handwritten signature, and that a printed copy of this Agreement is admissible as evidence.

This Agreement, together with the booking details it contains, is the entire agreement between us and replaces any earlier discussion or understanding.
